This data protection notice on the processing of personal data of contractual partners (hereinafter referred to as the “Notice”<\/strong>) describes how we use your personal data within the scope of your contract with us in accordance with the applicable data protection laws.<\/p>\n\n\n\n Within the scope of this Notice and as defined in the Declaration, “processing” refers to all activities relating to personal data, including collection, storage, use, retrieval, disclosure, transfer and transmission for the purposes specified therein, where applicable.<\/p>\n\n\n\n 1. What types of personal data do we collect and where do we obtain it?<\/strong><\/p>\n\n\n\n We will collect your personal data or that of your employees either directly from you in the context of the existing or pending purchase agreement or in the context of your interaction with our affiliated products. We may also collect your personal data from third parties (i.e. persons and organisations that do not belong to the Tadano Group). When we rely on third parties, such as service providers within the scope of our online shop, to collect and process your personal data on our behalf, we endeavour to enter into written agreements that oblige third parties to collect and process your personal data only in accordance with our instructions and local laws. In all cases, we collect your personal data in accordance with the principles set out in this statement. The personal data we collect about you includes the following categories of data:<\/p>\n\n\n\n \u00b7 Business contact details:<\/strong> Data such as name(s), business email address and telephone number, and personal data that you share with us, for example, in the course of communicating with us.<\/p>\n\n\n\n \u00b7 Contract-related data:<\/strong> Data such as name, position, signature, previous communications, and other data shared with us in the course of concluding a contract.<\/p>\n\n\n\n \u00b7 Data related to services and products used:<\/strong> IT data such as user names, passwords, access codes for product-related computer networks or systems, data related to the use of our online shop such as name, email address, IP address, cookies set, data resulting from the use of our AI chatbot, etc.<\/p>\n\n\n\n \u00b7 Other data:<\/strong> other data collected in connection with your business relationship with Tadano, e.g. images\/photos taken either during or in connection with your participation in events (these may be taken, for example, during filming within our factories\/sites or during organised photo shoots and internal or external events\/meetings, including external events, or other similar initiatives). Your image will be used for external communications if you have also granted us image usage rights.<\/p>\n\n\n\n If the personal data you have provided to us changes, such as your contact details, please inform your customer advisor or contact person immediately.<\/p>\n\n\n\n 2. Why do we process your personal data?<\/strong><\/p>\n\n\n\n We process personal data about you in accordance with applicable laws. Please note that our legal basis for processing your personal data may be subject to the legal provisions of the country in which you are located. There are also other legal bases for processing your personal data if the processing is necessary for one or more of the following reasons:<\/p>\n\n\n\n \u00b7<\/strong> Fulfilment of a contract between you and us (usually a purchase contract, e.g. between your company and us) or to take steps at your request prior to entering into a contract;<\/p>\n\n\n\n \u00b7 <\/strong>Fulfilment of a legal obligation applicable to us<\/p>\n\n\n\n \u00b7 <\/strong>to protect your\/our fundamental rights (or those of other persons); and<\/p>\n\n\n\n \u00b7 <\/strong>for the purposes of our legitimate interests, unless your interests or fundamental rights and freedoms in relation to the protection of personal data override such interests.<\/p>\n\n\n\n We generally process personal data about you for the purpose of managing the existing purchase agreement with you or your company and conducting our day-to-day business. Processing for these general purposes includes, but is not limited to, the following specific purposes:<\/p>\n\n\n\n \u00b7<\/strong> communicating with you;<\/p>\n\n\n\n \u00b7 <\/strong>administering the existing purchase agreement with you or your company;<\/p>\n\n\n\n \u00b7 <\/strong>sending product-related or general company newsletters;<\/p>\n\n\n\n \u00b7 <\/strong>organising event-related trips at the explicit request of the contractual partner;<\/p>\n\n\n\n \u00b7 <\/strong>internal or external publications for the management of our company’s online presence;<\/p>\n\n\n\n \u00b7 <\/strong>the security of Tadano’s sites, safety and health and occupational safety management;<\/p>\n\n\n\n \u00b7 <\/strong>Compliance and risk management;<\/p>\n\n\n\n \u00b7 <\/strong>Technical or operational support; or<\/p>\n\n\n\n \u00b7 <\/strong>Compliance with laws<\/p>\n\n\n\n 3. To whom do we disclose your personal data and why?<\/strong><\/p>\n\n\n\n We transfer data relating to our business operations, including personal data about you, to other companies within the Tadano Group. We share this data as necessary for the performance of the purchased service or product, as well as to ensure the provision of requested services by the responsible company. Some of the companies in the Tadano Group operate in countries that, according to the judgement of European authorities, do not have an adequate level of data protection for personal data (third countries)<\/strong>. Third countries include countries such as the United States of America, the People’s Republic of China, etc. There are corporate agreements between the companies of the Tadano Group with standard contractual clauses approved by the relevant European authorities, which oblige companies operating in a third country to protect all personal data about you that we pass on to them and your personal rights in relation to such data.<\/p>\n\n\n\n We may transfer personal data about you to third parties in accordance with this notice and the Statement. The broad categories of third parties to whom we may disclose your personal data are described in the Statement and include the following: our financial services provider, other administrators of services you receive in connection with the relevant purchase agreement, including tour operators; companies for which we provide services in which you are involved; accountants; solicitors; and other third-party providers who supply goods and services to us in connection with the provision of our services under the contract in general or specifically in connection with your purchase contract. We also transfer certain personal data about you to government authorities (including tax authorities) when required by law.<\/p>\n\n\n\n We endeavour to ensure that all non-governmental third parties to whom we transfer your personal data treat your personal data in accordance with the statement as part of their contract with us. If we transfer personal data about you to third parties operating in a third country, the transfer will only take place if:<\/p>\n\n\n\n (a) we have taken appropriate security measures to protect your personal data, such as by entering into a contract with the recipient;<\/p>\n\n\n\n (b) the transfer is necessary for one of the reasons set out in the data protection laws, such as to fulfil a contract between you and us; or<\/p>\n\n\n\n (c) you have expressly consented to the transfer.<\/p>\n\n\n\n 4. Where and for how long do we store your personal data ?<\/strong><\/p>\n\n\n\n We store personal data about you on computer systems that are either operated by Tadano Group companies themselves or operated on the instructions of Tadano Group companies and\/or on our premises. We store personal data about you both during and after the expiry of the existing contract, as long as this is necessary in connection with our and your legal rights and obligations or for the purposes for which it was collected; or to defend or enforce legal claims; or if this is otherwise required by applicable law. We and other Tadano Group companies will delete personal data about you in accordance with our retention policy upon your request (if such request is in accordance with the relevant legal requirements and is not otherwise restricted) and in any case after the expiry of the maximum retention period specified internally or by law.<\/p>\n\n\n\n 5. How do we ensure the security of your personal data?<\/strong><\/p>\n\n\n\n We have taken appropriate measures to prevent the accidental loss or unlawful use of, or unlawful access to, personal data. We restrict access to personal data to those individuals who need access in the course of their business activities. Such individuals who process personal data on our behalf or on behalf of another Tadano Group company may only do so in an authorised manner. They are also subject to a confidentiality obligation. We and every other Tadano Group company restrict access to our business premises and computer networks and take appropriate steps to secure data from unauthorised access to such business premises and computer networks. We have procedures in place to deal with suspected data breaches and will notify you and any applicable authorities of any suspected data breach where we are legally required to do so.<\/p>\n\n\n\n 6. What rights do you have in relation to your personal data and how can you exercise them?<\/strong><\/p>\n\n\n\n Under local law, you may have certain rights in relation to all personal data we hold about you. To do so, we will collect information from you, including, where applicable, your name, national identification number, date of birth, contact details, answers to security questions, and other personal identification data. We will compare this information with information we have previously collected about you in order to verify your identity and respond to your request. Information collected for the purpose of verifying your request will only be used to verify and respond to your request to exercise your rights regarding personal information.<\/p>\n\n\n\n If we are unable to verify your identity in connection with your request, we will not be able to process your request.<\/p>\n\n\n\n If you wish to appoint an authorised representative to submit a request on your behalf, we will require you to verify your identity directly with us before we provide the requested data to your authorised representative.<\/p>\n\n\n\n 7.
