Tadano Pro App
These Terms of Use (“Terms”) apply to the registration and use of the Tadano Pro App provided by Tadano to Users.
Tadano Pro App
With the Tadano Pro App (“App”), Tadano provides users with information about Tadano products, including images, data sheets, product presentations and product videos.
The Tadano Pro App was developed to have central machine data quickly available and to better understand Tadano products. Any misuse and any violation of these terms and conditions are prohibited.
Registration, no passing on
Use may require prior registration or activation by Tadano. Information provided by the user must be truthful. After successful registration, the app can be used.
There is no entitlement to use or activate the app.
Use is restricted to the respective user. Passing on the app to third parties is prohibited. The same applies to passing on the contents of the app, in particular pictures, data sheets, product presentations, product videos.
Technical requirements
Use requires an existing data connection (WLAN, WiFi), which the user must set up and maintain himself and at his own expense. The user is responsible for ensuring that his hardware and software are sufficiently up to date.
The use of the app is only possible on certain operating systems.
Continuous use of the app cannot be guaranteed. In particular, use may be interrupted by maintenance, network faults and other events.
Warranty
The product data available in the app do not represent data of individually configured products and do not depict a concrete load/heating situation.
THE USE OF THE APP IN NO WAY REPLACES THE FULL OBSERVANCE OF THE OPERATING INSTRUCTIONS AND THE INSTRUCTIONS FOR THE TADANO CRANES.
The app is not suitable for the compilation of statistics or other applications that require accurate, reliable, quality-checked, current, and uninterrupted or constantly available measurement data. For technical reasons, the app is not suitable for providing third parties with proof of what loads the previously selected Tadano crane type can lift, rotate and lower in its actual environment, with regard to its actual use and in what radius, or how the crane behaves under a specific load.
Tadano does not provide any warranty for the product data available in the app.
Tadano is not liable for the availability and functionality of the app.
Right of use
With the installation of the app, the user receives the non-exclusive, non-transferable right of use, limited in time to the product life of the app and restricted to the respective content, to use the app within the scope of these conditions.
These terms and conditions do not result in a transfer of the software or the granting of further rights of use.
It is prohibited to change, manipulate, or impair the app by technical means.
Changes, termination
The app is a voluntary, free offer by Tadano. Tadano is entitled at any time to temporarily or permanently restrict, change, or expand the scope of use of the app or to restrict or completely discontinue its use.
In particular, Tadano is entitled at any time to adapt these terms and conditions, to introduce other terms and conditions or to make technical changes, e.g., to add or remove individual functions or features.
Data protection
Reference is made to the privacy policy for the Tadano Pro App.
Law, place of jurisdiction
Applicable law is exclusively the law of the Federal Republic of Germany.
The place of jurisdiction is Zweibrücken, Germany.
